Subject to these Terms, PlainReal grants you a non-transferable, non-exclusive, revocable, limited license to access and use the Site for informational purposes. This license does not include any right to access the PlainReal product, APIs, or signing infrastructure, which are governed by separate agreements.
You may not: (a) use the Site to build a competing product or service; (b) attempt to gain unauthorized access to any part of the Site or its infrastructure; (c) use automated tools to scrape, crawl, or extract data from the Site beyond what is permitted in our robots.txt; (d) transmit malware, spam, or other harmful code via the Site; or (e) use the Site in violation of any applicable law or regulation.
We reserve the right to modify, suspend, or discontinue the Site at any time without notice. We are not liable to you for any modification or discontinuation.
All content on the Site, including text, code, graphics, logos, and the PlainReal record schema, is owned by AgentOS Technologies, Inc. or its licensors and is protected by applicable intellectual property law. The OWASP Agentic AI Top 10 mapping and SP 800-53 mapping published in our GitHub repository are released under the Apache 2.0 License as stated in that repository. Nothing in these Terms transfers any intellectual property rights to you except the limited access rights described in Section 1.1.
If you provide feedback or suggestions about the Site or the PlainReal product, you assign all rights in that feedback to PlainReal. We may use feedback for any purpose without compensation or attribution.
When you submit a request via the Site's contact form, you represent that: (a) the information you provide is accurate; and (b) you have authority to make inquiries on behalf of any company you represent. You are responsible for any information you submit. PlainReal is not obligated to respond to every submission.
The Site links to third-party sites including GitHub, regulations.gov, and LinkedIn. These links are provided for convenience. PlainReal does not control linked sites and is not responsible for their content or privacy practices. Your use of linked sites is at your own risk and subject to their terms.
You agree to indemnify and hold PlainReal, its officers, employees, and agents harmless from any claim or demand arising from: (a) your use of the Site; (b) your violation of these Terms; or (c) your violation of any applicable law. PlainReal reserves the right to assume exclusive defense of any matter subject to indemnification, at your expense.
These Terms remain in effect while you use the Site. We may terminate your access at any time for any reason, including violation of these Terms. Sections 2, 5, 6, 7, 9, and 10 survive termination.
Any dispute between you and PlainReal arising from or relating to these Terms or your use of the Site will be resolved by binding arbitration, not in court, except that either party may bring individual claims in small claims court, or seek injunctive relief in court for infringement of intellectual property rights.
Before initiating arbitration, you agree to first contact PlainReal at contact@plainreal.com with a written description of the dispute and the relief you seek. We will make good-faith efforts to resolve the dispute within 45 days. Completion of this informal process is a condition precedent to arbitration.
Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules for disputes under $250,000, and its Comprehensive Rules for larger disputes. JAMS rules are available at jamsadr.com. The Federal Arbitration Act governs this agreement. Unless you and PlainReal agree otherwise, arbitration will be conducted in the county where you reside.
The arbitrator has exclusive authority to resolve all disputes subject to arbitration, including disputes about the scope and enforceability of this arbitration agreement, except that courts have exclusive authority to resolve disputes about the class action waiver in Section 9.5 and disputes about whether the informal resolution condition has been satisfied.
You and PlainReal agree that all disputes will be resolved only on an individual basis. Neither party may bring a claim as a class member or representative in any class or collective proceeding. If this class action waiver is found unenforceable, the affected claim will be severed from arbitration and resolved in court in Delaware.
By agreeing to arbitration, you waive the right to a trial by jury for all claims covered by this agreement.
Each party bears its own attorneys' fees in arbitration unless the arbitrator finds the dispute was frivolous or brought for an improper purpose.
You may opt out of this arbitration agreement by sending written notice to contact@plainreal.com or by mail to AgentOS Technologies, Inc., c/o Legalinc Corporate Services Inc., 131 Continental Dr, Suite 305, Newark, DE 19713, within 30 days of first using the Site. Your notice must include your name, email, and a clear statement that you are opting out. Opting out does not affect any other part of these Terms.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any court proceedings not subject to arbitration will be brought in the state or federal courts located in Delaware.
We may revise these Terms at any time by posting an updated version on the Site. Material changes will be accompanied by a revised "Last updated" date. Continued use of the Site after changes are posted constitutes your acceptance.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PlainReal regarding use of the Site. They do not govern use of the PlainReal product, which is subject to separate written agreements. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.
